Terms and Conditions

  1. Services

Belkins Estate provides real estate lead generation and referral services to real estate agents and brokers (“Agents”). By using our services, you agree to these Terms and Conditions.

  1. Lead/Referral Acceptance

Agents can review and accept or deny leads/referrals within 24 hours. Acceptance is automatic if no action is taken.

  1. Fees and Payment
  • Membership Fee: A non-refundable membership fee is required to join Belkins Estate. The fee amount depends on the chosen plan.
  • Referral Fee: Agents pay a referral fee upon successful client acquisition. The fee structure varies based on the membership plan.
  • Payment Terms: Referral fees are due within 14 days of transaction closing and funding.
  1. Refunds and Disputes
  • Membership Fee: The membership fee is generally non-refundable. However, we understand that there may be exceptional circumstances. If you encounter issues with our services, please contact Belkins Estate support for assistance.
  • Referral Fee Disputes: All chargebacks and billing disputes must be reported within 7 days of the transaction. Disputes initiated without prior notification may result in partial refunds or additional fees. For the Pro Plan, agents must report all disputes within three (3) calendar days in the form of a text, call, or email to Belkins Estate. If the Agent disputes a wrongful chargeback with his/her credit card issuer without notifying Belkins Estate, then the Agent/Broker waives all rights to dispute and shall pay Belkins Estate an “Administrative Fee” in the amount of $250 along with attorney cost and any additional collection cost/charges.

Refund Eligibility:

Refunds may be considered under the following limited circumstances:

  1. Inaccurate Lead Information: If the lead information provided is demonstrably inaccurate and cannot be rectified with a replacement lead within the initial 60 days of your membership.
  2. No Leads Provided: If you have not received any leads within the initial 60 days of your membership.

Dispute Reporting:

To be eligible for a refund, you must report any concerns regarding lead accuracy or the lack of leads within the timeframe specified in your agreement (3 days for Pro, 7 days for Starter/Elite). Please contact us via phone or email at support@belkinsestate.com.

Refund Process:

To request a refund, please submit a written request via email to support@belkinsestate.com, providing details of the issue and any supporting documentation.

  1. Term and Termination

This agreement automatically renews annually upon payment of the membership fee. Either party may terminate with 120 days’ written notice. Termination does not impact compensation owed for accepted leads.

  1. Confidentiality

All information shared through the platform is confidential and will not be disclosed to third parties without consent or legal requirement.

  1. Limitation of Liability

Belkins Estate is not liable for indirect, special, or consequential damages arising from the use of our services.

  1. Dispute Resolution

Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

  1. Changes to Terms

Belkins Estate reserves the right to update these Terms and Conditions. Continued use of our services constitutes acceptance of any changes.By using Belkins Estate’s services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
